1. Eligibility

The Contest is open only to legal residents across all provinces of Canada excluding Québec (the “Participating Provinces”) who have a valid Scene+ account, have downloaded, created and/or have an account on the Sobeys, Foodland, FreshCo, or Safeway mobile app with their Scene+ account registered to their profile, and who have reached the age of majority in their province of residence on the date that they entered the Contest. Void where prohibited by law. Employees, directors, officers, representatives, agents of Sobeys Capital Incorporated (the “Sponsor”), XMC Experiential Marketing (the “Administrator”), and each of their respective parent companies, affiliates, franchisees, subsidiaries, distributors, representatives, advertising and promotional agencies, agents, sponsors, and any entity that they contract with specific to the Contest, as well as the immediate family members, and any persons domiciled with any of the above (whether related or not), are not eligible to win a sweepstake prize.

2. Contest Period

The Contest runs from March 26, 2026 and ends on April 29, 2026 (the “Contest Period) and contains five (5) weekly challenge periods (each a “Weekly Challenge Period”):

3. How to Enter without Purchase – Entry Requirements

NO PURCHASE IS NECESSARY. To enter the Contest without a purchase, you must enroll in the Sobeys, Foodland, FreshCo, and/or Safeway mobile app (collectively referred to as the “Apps”), link your Scene+ account number to your profile, complete the entry form (the “Entry Form”) in the “How to Play” section of the Apps, and check off the boxes agreeing to the Contest rules. Upon enrollment, successful linking, and completion of the Entry Form, each user (each a “User”) will receive thirty (30) enrollment Chips (an “Enrollment Chip”) into the Contest. Each User will receive thirty (30) Enrollment Chips for each App downloaded and account signed in, for a total of up to two hundred twenty (220) Enrollment Chips.

If you are an existing User who would like to enter and have already linked your Scene+ account number to your profile on any of the Apps, you will automatically receive one hundred (100) Enrollment Chips when signing into your account and after completing the Entry Form.
The Contest can be found on the home page of the Apps.

Once an account has been created and Scene+ account linked or if the User already has an account with a linked Scene+ account number, Users will find challenge tiles within the Apps and be prompted to complete these challenges (each a “Challenge”) during the Contest Period within each Weekly Challenge Period for a chance to earn additional chips into the Contest. The list below explains how to complete each Challenge and the number of chips Users can earn. Users can choose which sweepstake prizes (as defined in Section 4 below) they want to allocate their chips towards.

The available non-purchase Challenges include:

1. Open any of the Apps during each Weekly Challenge Period: To complete this Challenge, each User must open one of the Apps at least once in each Weekly Challenge Period to earn five (5) app Chips (an “App Chip”). Users can earn up to twenty (20) App Chips in each Weekly Challenge Period by opening each App listed above once per Weekly Challenge Period for a total of up to one hundred (100) App Chips during the entire Contest Period.
2. Click the "Offer" tab within the App to view available offers: Each User that clicks on the “Offer” tab within the Apps to view the offers available to them, will earn fifteen (15) offer chips (an “Offer Chip”). Users can earn up to sixty (60) Offer Chips by clicking the “Offer” tab within each individual App, once per Weekly Challenge Period for a total of up to three hundred (300) Offer Chips during the entire Contest Period.
3. Create a Shopping List within the Apps: To complete this Challenge, Users must create one shopping list within any of the Apps in order to earn five (5) shopping list chips (a “Shopping List Chip”). Users can earn an additional five (5) Shopping List Chips if they create a shopping list within each of the Apps. For example, if you create one shopping list in each of the Apps, Users will earn a total of twenty (20) Shopping List Chips in one Weekly Challenge Period. Users can earn up to a total of one hundred (100) Shopping List Chips by creating a shopping list within each App during each Weekly Challenge Period during the entire Contest Period.
4. Tap the "Share" button on a recipe within the App: To complete this Challenge, Users must click on the “Share” button found on any recipe within the Sobeys, Foodland, and/or Safeway app and share the recipe using the “share” function on the Apps. Once completed, Users will earn five (5) share chips (a “Share Chip”). Users can earn up to a total of seventy-five (75) Share Chips by completing this Challenge within all three of the Apps mentioned above, once during each Weekly Challenge Period during the entire Contest Period.
5. General Trivia Questions: To complete this Challenge, Users must click on the Trivia Question Challenge tile within any of the Apps and answer the five (5) prompted multiple choice questions. Users will earn five (5) trivia chips just for answering the questions and completing this Challenge (a “Trivia Chip”). Users will earn one (1) additional Trivia Chip for each correctly answered multiple choice question. Users can earn up to a total of four hundred (400) Trivia Chips by completing this Challenge in all of the Apps, during each Weekly Challenge Period during the entire Contest Period.
6. Voila Trivia Questions: To complete this Challenge, Users must click on the Voila Trivia Question Challenge tile within the Sobeys and/or Safeway apps and answer the five (5) prompted multiple choice questions. Users will earn five (5) Voila trivia chips just for answering the questions and completing this Challenge (a “Voila Trivia Chip”). Users will earn one (1) additional Voila Trivia Chip for each correctly answered multiple choice question. Users can earn up to a total of forty (40) Voila Trivia Chips by completing this Challenge, during each Weekly Challenge Period during the entire Contest Period.
7. Spin the Wheel Challenge: You can access the Spin the Wheel challenge through any of the four Apps. You may participate once per week per App. The wheel contains six equal slices, each with an equal one-sixth (1/6) chance of landing:

   250 Scene+ points

   Chips (2 slices):
   25 chips
   50 chips
   

   If you land on the Scene+ Points slice, a digital offer for the points will be available in your Offers tab within 48 hours of your spin. To claim your points, you must load the digital offer and redeem it in-store by scanning your Scene+ card or providing your Scene+ account number and completing a transaction, with a minimum purchase of $10.00. Additional terms and conditions apply and found on the digital offer in the Apps. You can earn up to a total of two thousand (2,000) Scene+ points if you land on the 100-Scene+ points slice in each Weekly Challenge Period if played using all of the Apps, you can earn up to a total of five thousand (5,000) Scene+ points if you land on the 250-Scene+ points slice in each Weekly Challenge Period if played using all of the Apps, you can earn up to a total of ten thousand (10,000) Scene+ points  if you land on the 500-Scene+ points slice in each Weekly Challenge Period if played using all of the Apps or you can earn up to a total of fifteen thousand (15,000) Scene+ points if you land on the 750-Scene+ points slice in each Weekly Challenge Period if played using all of the Apps during the entire Contest Period, and claim the digital Scene+ points offers as described above. Return each week to spin again—one spin per App, per Weekly Challenge Period—throughout the Contest Period.

   If you land on a ‘chips’ slice, the corresponding number of wheel chips (each, a “Wheel Chip”) identified on the slice will be added automatically to your account and you can choose where to allocate those Wheel Chips. You can earn up to a total of two hundred (200) Wheel Chips if you land on the 25-chip slice in each Weekly Challenge Period, during the entire Contest Period. You can earn up to a total of one thousand (1,000) Wheel chips if you land on the 50-chip slice in each Weekly Challenge Period, during the entire Contest Period. Return each week to spin again—one spin per App, per Weekly Challenge Period—throughout the Contest Period.

8. Guess the Foods Challenge: To complete this challenge, Users must click on the Guess the Foods Challenge tile within any of the Apps and start the challenge by guessing and typing in what you believe is the correct food related word within six (6) attempts. Upon completion of this challenge, the user will be awarded five (5) chips for playing, and an additional ten (10) chips (a “Guess the Food Chip”) if the food word was guessed correctly within the six (6) attempts. If the player abandons or exits the game before it is completed or solved, the challenge will be marked completed for that week. Users can play once during each Weekly Challenge Period on all the Apps, during the Contest Period. Users can earn up to a total of three hundred (300) Guess the Food Chips by completing this challenge during the Contest Period.
9. Find a Product Challenge: To complete this challenge, Users must click on the “Start Challenge” button for this Challenge, which will automatically copy the designated “variable search product” for that current Weekly Challenge Period. Once you have clicked on the button, Users must navigate to the search bar and paste the term (or tap to populate) to execute the search. Once you have clicked on the product and are directed to its landing page, you will earn twenty (20) chips (a “Product Chip”). During each Weekly Challenge Period, the specific product will change, and Users will be required to search for that specific product. There will be a total of eight (8) Find a Product Challenges throughout the duration of the Contest Period. Users can earn twenty (20) Product Chips for each Find a Product Challenge completed. Users can earn up to a total of six hundred forty (640) Product Chips by completing this challenge on each of the Apps in each Weekly Challenge Period, during the Contest Period.
10. Find a Department Challenge: To complete this challenge, Users must click on the “Start Challenge” button for this Challenge, which will automatically copy the designated “variable search department” for the current Weekly Challenge Period. Once you have clicked on the button, Users must navigate to the search bar and paste the term (or tap to populate) to execute the search. Once you have clicked on the department and are directed to its landing page, you will earn ten (10) chips (a “Department Chip”). During each Weekly Challenge Period, the specific department name will change, and Users will be required to search for that department listed. Users can earn ten (10) Department Chips during each Weekly Challenge Period by completing this challenge in each App for a total of forty (40) Department Chips. Users can earn up to a total of two hundred (200) Department Chips by completing this challenge on each of the Apps in each Weekly Challenge Period, during the Contest Period.
11. Favorite an Item Challenge: To complete this challenge, Users must visit the product page on any of the Apps and favorite any item (pressing the heart button) to earn five (5) chips (a “Fave Item Chip”). Users can complete this challenge once on each App per Weekly Challenge Period, during the Contest Period. Users can earn up to a total of one hundred (100) Fave Item Chips by completing this challenge during the Contest Period.
12. Add a Recipe to Meal Plan Challenge: To complete this challenge, open any recipe on one or all of the following Apps: Safeway, Sobeys and Foodland, and click the “Add to Meal Plan” button to earn fifteen (15) chips (a “Meal Plan Chip”). Users can complete this challenge once on each of the Apps listed above in this challenge, per Weekly Challenge Period, during the Contest Period. Users can earn up to a total of two hundred and twenty-five (225) Meal Plan Chips by completing this challenge during the Contest Period.
13. View a Flyer Challenge: To complete this challenge, Users must click on the Flyers tab on any of the Apps and click one of the available digital Flyers to view the Flyer to earn five (5) chips (a “Flyer Chip”). Users can complete this challenge once on each App per Weekly Challenge Period, during the Contest Period. Users can earn up to a total of one hundred (100) Flyer Chips by completing this challenge during the Contest Period.
14. Favourite a Recipe Challenge: To complete this challenge, Users must visit the recipe page on one or all of the following Apps: Safeway, Sobeys and Foodland, and favorite any recipe (pressing the heart button) to add that recipe to the Favourites folder under My Recipe List and earn five (5) chips (a “Fave Recipe Chip”). Users can complete this challenge once on each of the Apps listed above in this challenge, during the Contest Period. Users can earn up to a total of seventy-five (75) Fave Recipe Chips by completing this challenge during the Contest Period.
15. Find your Scene+ card on the mobile app Challenge: To complete this challenge, Users must click on the Open your Scene+ digital card tab within any of the Apps to earn twenty (20) chips (a “Scene+ Digital Card Chip” and together with the Enrollment Chips, App Chips, Offer Chips, Shopping List Chips, Share Chips, Trivia Chips, Voila Trivia Chips, Wheel Chips, Guess The Food Chips, Product Chips, Department Chips, Fave Item Chips, Meal Plan Chips, Flyer Chips, and Fave Recipe Chips, the “No Purchase Chips”). Users can complete this challenge once on each App per Weekly Challenge Period, during the Contest Period. Users can earn up to a total of four hundred (400) Scene+ Digital Card Chips by completing this challenge during the Contest Period.

By participating in this Contest and completing each of the Challenges, you agree to have read, accept, and will abide by these Contest Rules, the entry requirements, and Sobeys privacy policy.

Limit of four thousand two hundred and seventy-five (4275) No Purchase Chips per User, during the entire Contest Period. For all unallocated No Purchase Chips earned throughout the Contest Period, each User will have up until May 6, 2026 to allocate their No Purchase Chips towards a chance to win their desired sweepstake prize. Users can allot any number of Chips (as defined below) into any of the available sweepstake prizes. Once the Chips have been submitted, they cannot be withdrawn.
 
No Purchase Chips will bear the same odds of winning as Purchase Chips.

4. How to Enter with Purchase – Entry Requirements

To enter the Contest with a purchase, each User must complete the Challenges listed below:

1. Redeem any loaded digital offer in-store: Complete this Challenge by using your choice of any two of the four Apps listed above. Users who redeem any offer found in the “Offer” tab within only two of the Apps, in-store, will earn thirty (30) redeem chips (a “Redeem Chip”) for each offer redeemed. For this Challenge, Users can redeem multiple offers from two of the Apps at once in a single or multiple transactions to earn up to one thousand eight hundred (1800) Redeem Chips during each Weekly Challenge Period. Users can earn up to a total of nine thousand (9000) Redeem Chips by completing this Challenge using the two Apps you have chosen, if completed during each Weekly Challenge Period during the entire Contest Period.
2. Complete a set number of the above Challenges within each Weekly Challenge Period: This Challenge can only be completed using one of the Apps listed above. In each Weekly Challenge Period, Users can earn Chips by completing a set number of the above-listed no purchase option or purchase option Challenges (each, a “Challenge Chip Challenge”) in accordance with the table below (each, a “Challenge Chip”). All Challenge Chip Challenges will be available at all times during the Contest Period for Users to complete this Challenge. If Users complete and redeem any of the Challenge Chip Challenges, Users will receive those Chips (as defined below) in addition to the stated number of Chips Users can earn, indicated in the third column of the table below. Users can complete any of the Challenge Chip Challenges listed in these Contest Rules to complete this Challenge:

Users can earn up to a total of one hundred fifty (150) Challenge Chips by completing this Challenge in each Weekly Challenge Period. For clarity, Users must complete the set number of Challenge Chip Challenges in each Weekly Challenge Period for this Challenge in order to earn the full amount of Challenge Chips. Users will not receive a lesser number of Chips (as defined below) if they complete less than the number of Challenge Chip Challenges required to complete in each Weekly Challenge Period indicated in the second column of the table above. Users can earn up to a total of six hundred (600) Challenge Chips for completing this Challenge correctly in each Weekly Challenge Period during the entire Contest Period.

By participating in this Contest and completing each of the Challenges, you agree to have read and will abide by the Contest Rules, the entry requirements, and Privacy Policy.

Redeem Chips and Challenge Chips are collectively referred to as the “Purchase Chips”.

Users can earn up to a total limit of nine thousand six hundred (9600) Purchase Chips per User, during the entire Contest Period. For all unallocated Purchase Chips earned throughout the Contest Period, each User will have up until May 6, 2026 to allocate their Purchase Chips towards a chance to win their desired sweepstake prize. Users can allot any number of Chips into any of the available sweepstake prizes. Once the Chips have been submitted, they cannot be withdrawn.

Purchase Chips and No Purchase Chips are collectively referred to as “Chips”.

During the entire Contest Period, Users can earn up to a total limit of thirteen thousand eight hundred seventy-five (13875) total Chips available to be earned per User.

5. Sweepstake Prize Descriptions

There are thirty-two (32) sweepstake prizes to be won throughout the entire Contest Period: 6 x 1,000,000 Scene+ points (ARV: $10,000.00 (CAD) each), 3 x Cineplex Showtime Cards (ARV: $3,650.00 (CAD) each), 2 x Scotiabank Cash Prize deposited into a Scotiabank investment plan or any other eligible Scotiabank account* (ARV: $5,000.00 (CAD) each), 20 x  Home Hardware gift cards (ARV: $500.00 (CAD) each), and 1 x 1,000,000 Scene+ points that can be used towards Scene+ Travel Powered by Expedia (ARV: $10,000.00 CAD) (each a “Sweepstake Prize” and together the “Sweepstake Prizes”).

*If the potential winner does not have a Scotiabank account and/or does not want to open one, the Prize will be awarded as a $5,000.00 (CAD) cheque.

The following conditions apply to the Sweepstake Prizes:

• The Sweepstake Prizes have no equivalent cash value, are non-transferable and no substitutions will be made. Sweepstake Prize must be accepted as awarded. The Sponsor reserves the right to substitute any Sweepstake Prize for one of equal or greater value for any reason. You are responsible for all costs not expressly described as being included as part of the Sweepstake Prize, such as any fee associated with the receipt and/or use of the Sweepstake Prize. 
• You must sign the Sponsor’s release form (the “Release”) in order to receive and participate in the Sweepstake Prize.
• Scene+ points are subject to the Scene+ Program Terms and Conditions.
• The 1,000,000 Scene+ points are intended for redemption for Travel through Scene+ Travel, Powered by Expedia and are subject to the Scene+ Program Terms and Conditions, including the Additional Terms and Conditions for Scene+ Travel.
• Cineplex Free Movies For A Year Card Terms and Conditions apply:  The Cineplex Showtime card (the “Card”) is personalized with the winner’s name, and is redeemable for one (1) year from date of issue, for admission to movies at Cineplex theatres in Canada. Maximum of one (1) admission ticket each day. Photo identification must be presented with the card at the box office to obtain admission tickets. Cards cannot be used to purchase tickets online or through the Cineplex mobile app. Cards may not be used by anyone other than the named cardholder. The named cardholder must attend the theatre to obtain and use the admission tickets. Improper use of the card (including selling the admission tickets) may result in the card’s cancellation at Cineplex’s sole discretion. Accepted for same-day performances only. Cards may be applied to the purchase of an admission ticket to select presentations in 3D, IMAX®, UltraAVX®, VIP (age restricted), D-BOX, 4DX or Screen X with the payment of an applicable surcharge (based on location and presentation) that can range between two dollars ($2) and twelve dollars ($12) per admission ticket. Cards cannot be used at drive-in theatres owned or operated by Cineplex or for Event Cinema or non-feature film presentations, including but not limited to, opera, theatre, concerts and sporting or eSports events. Free tickets are not eligible to earn Scene+TM points. Card will be shipped by mail directly by Cineplex to the winner at the residential address the winner provided during the Prize verification process, for receipt in approximately ten (10) to twelve (12) weeks after all winners have been verified.
• Scotiabank Sweepstake Prizes are subject to meeting Scotiabank’s standard customer onboarding requirements and applicable account agreements. In order to claim a Scotiabank Sweepstake Prize, the potential winner must attend an in-person appointment at a Scotiabank branch at a mutually agreeable time between June 1, 2025 to December 31, 2025 to meet with a Scotiabank advisor. It is the potential winner's responsibility to monitor any limits under applicable tax legislation relating to assets in a registered account. Scotiabank is not responsible for any negative tax consequences the potential winner may experience. Potential winners should also consult with their own tax and legal advisors before investing. *If the potential winner does not have a Scotiabank account and/or does not want to open one, the Prize will be awarded as a $5,000.00 (CAD) cheque.
• Any difference between approximate retail value and the actual value of the Sweepstake Prizes as taken will not be awarded.
• Home Hardware gift cards (“HH Cards”) are subject to Home Hardware Terms and Conditions. Gift Card increments will be allocated at the Sponsor’s discretion. HH Cards can be used to purchase eligible goods and services online at homehardware.ca and instore at participating Home Hardware, Home Hardware Building Centre, Home Building Centre, and Home Furniture stores in Canada (“Home Stores”). The full stored value of the HH Card will be applied to the total eligible amount of your in-store or online purchase. Any unused portion will remain on the HH Card and can be applied towards future purchases.  HH Cards cannot be exchanged for cash. HH Cards do not expire and are non-refundable. Purchases made on HH Cards may be refunded. HH Cards cannot be used to purchase any of the following goods: lottery products, hunting & fishing licenses, firearms, ammunition, crossbows, beverage alcohol, cannabis, cigarettes, vapes, tobacco products, gift cards, pre-paid cards, other stored value cards or products, and items prohibited by law. You will not be sent statements of itemized transactions relating to your use of your HH Card. You can inquire about your HH Card balance at a participating Home Store’s customer service desk or by calling 1-877-384-7818. You are responsible for all transactions relating to your HH Card, whether authorized or not. Protect your HH Card like cash. Home Hardware Stores Limited is not responsible for replacing HH Cards that are lost, stolen, destroyed, damaged, or used without your authorization. HH Cards may be void if altered, damaged or defaced. A receipt is required for returns of purchases made with an HH Card. If you return your purchase that you paid for using an HH Card to a Home Store, refunds will be go on the same HH Card or issue you a new HH Card with the refund amount.

6. Odds

The odds of winning a Sweepstake Prize depends on the total number of eligible Chips submitted to each available Sweepstake Prize during the entire Contest Period.

7. Draw Details

Random draws will be conducted by an agent of the Administrator located in Toronto Ontario, Canada, from all eligible Chips received during the Contest Period (the “Draws”). The Draws will occur on May 26, 2026. You do not need to be in attendance to be selected. You are only eligible to win a Sweepstake Prize once.

8. Winner Contact Details

If you are chosen to be eligible to win a Sweepstake Prize, you will be contacted within fourteen (14) business days of the Draw at the telephone number, email address or using the contact information found within the Apps. If you have not provided a telephone number or email address, you are not eligible to win the Sweepstake Prize. By participating in this Contest, you consent to the Sponsor/Administrator or a representative of the Sponsor/Administrator using your Scene+ number to identify you should you be selected as the potential winner. In order to be declared a winner, you must correctly answer without assistance a mathematical skill-testing question and sign a Release. Upon verification of the completion and correctness of the answer to the skill-testing question, and execution of the Release, you may be declared a winner. The agent of the Administrator will be contacting potential winners using the following email: sceneplusprizes@sobeys.ca In case of a dispute concerning the identity of the individual who submitted any Chips, the entrant will be deemed to be the account holder of the email address under which the Chips were submitted.

9. Forfeit of Sweepstake Prize

If you cannot be reached within seven (7) days of our first attempt to contact you, do not answer the skill-testing question correctly, do not claim your Sweepstake Prize within seven (7) days, or otherwise fail to comply with these Contest Rules, then the Sweepstake Prize will be forfeited, and another entrant will be randomly selected from among the remaining eligible Chips as per these Contest Rules. This process of selecting a Sweepstake Prize winner will be repeated until all Sweepstake Prizes eligible to be won have been awarded.

10. Use of Personal Information

By entering the Contest and voluntarily providing your personal information as described in these Contest Rules, you agree to the collection, use and disclosure by the Administrator, and its respective employees and/or authorized agents, of your personal information, for the purpose of administering the Contest, including—but not limited to—contacting you with respect to the Contest if you are a selected entrant. Personally-identifiable information will only be used to administer the Contest and for no other purpose, except as specifically outlined in these Contest Rules.  Personally-identifiable information will not be sold, shared or disclosed by the Administrator to any third party, other than to a third party engaged by the Administrator for the purpose of administering the Contest, or if required by law with the exception that aggregated information may be used by or shared amongst the Administrator and its subsidiaries and affiliates, or shared by the Administrator with third parties in accordance with our Privacy Commitment available at https://www.sobeys.com/en/privacy-policy.

11. Publicity Consent

By entering the Contest, you agree that if you are determined to be a winner, the Administrator and the Sponsor may use your name, comments, voice, likeness, municipality of residence, your Contest submission and photo submission and picture in any advertising, promotion or publicity carried out now or in the future, in any media without compensation or notice, and you grant to the Administrator and the Sponsor any and all rights to such use. You agree to cooperate with the Administrator and the Sponsor in arranging for photographs or other forms of publicity and to be available for photographs or other forms of publicity on reasonable notice.

12. Limitation of Liability / Release

By participating in the Contest, and as a condition of acceptance of the Sweepstake Prize, you, your heirs, executors, administrators, successors and assigns, release and forever discharge and hold harmless the Sponsor, the Administrator, Scotiabank (The bank of Nova Scotia), Cineplex Inc., Home Hardware Stores Limited, Scene Limited Partnership, and each of their respective direct and indirect parent companies, affiliates, subsidiaries, successors, assigns, agents, advisors, franchisees, shareholders, partners, representatives, their advertising, promotion and fulfillment agencies and each of their respective employees, officers, directors, agents and representatives (collectively, the “Released Parties”), from and against any and all losses, damages (including, without limitation, direct, indirect, incidental, consequential or punitive damages), rights, claims, actions, causes of action, personal injury, property damage or death, including without limitation all costs and liabilities of any kind including legal fees on a substantial indemnity scale, hereinafter called “Claims” and including without limitation any Claims arising from any act of negligence of the Released Parties, that you now have, or may hereafter have against the Released Parties directly or indirectly resulting or arising from: (i) participation in the Contest, your Chips and/or the awarding, acceptance, possession, use, or misuse or enjoyment of any Sweepstake Prize, and where applicable, traveling to, preparing for, or participating in, any Contest-related or Sweepstake Prize-related event or activity; or (ii) the publicity rights granted to the Sponsor and the Administrator. You specifically acknowledge that you understand that there may be serious risks of bodily injury, death, or property damage associated with the acceptance, possession, use and/or misuse of the Sweepstake Prize and attendance at any event or participation in certain Sweepstake Prize-related activities, and you voluntarily assume these risks. You also agree to indemnify, defend, and hold harmless the Released Parties from any and all Claims in respect of the foregoing.

13. Compliance with Rules

By entering the Contest, you agree to abide by the entire Contest Rules and the terms and conditions under which the Sweepstake Prizes are awarded. Any decision made by the Sponsor and/or the Administrator in respect of this Contest shall be final.

14. Technical Issues

The Sponsor and Administrator are not responsible for any computer, online, telephone, hardware, software or technical limitations or malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of any Chips, or failure to receive any Chips), nor for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of Chips in the Contest, nor for any error, omission, interruption, deletion, defect, delay in operation or transmission or receipt of any Chips, communications line failure, theft or destruction or unauthorized access to, or alteration of Chips; and, are not responsible for any problems, failures or technical malfunction of any telephone or network lines, computer online systems, servers, providers, computer equipment, software, email, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website or on account of any combination of the foregoing; and are not responsible for any injury or damage to entrants or to any computer-related injury or damage resulting from participating in downloading materials in this Contest.

In the event that, due to a printing, manufacturing, mechanical or other error of any kind or nature whatsoever, more Sweepstake Prizes are claimed than are intended to be awarded according to these Contest Rules, Sweepstake Prizes will stop being awarded when the Administrator becomes aware of an error respecting the number of Sweepstake Prizes and the Administrator reserves the right, in their sole and absolute discretion, to conduct a random draw from amongst all eligible and approved Sweepstake Prize claimants whose claims have not yet been redeemed to award the remaining number of advertised Sweepstake Prizes. In no event will the Sponsor or Administrator be liable for more than the stated number of Sweepstake Prizes contained in these Contest Rules.

15. Rights to Terminate / Modif y / Suspend Contest

The Administrator and Sponsor retain the right, in their absolute discretion, to suspend, modify or terminate any aspect of the Contest (including, but not limited to these Contest Rules) at any time. The Administrator and Sponsor may make substitutions of equivalent kind or value in the event of the unavailability of a Sweepstake Prize (or component thereof) for any reason whatsoever. The Administrator and Sponsor may terminate or withdraw this Contest at any time by posting a notice on their website. If the Contest is terminated on any day prior to the normal Contest end date (the “Termination Date”), the Administrator and Sponsor may determine the winners from all eligible Chips received as of 12:00pm on the Termination Date (which winners shall be randomly selected in accordance with these Contest Rules).

16. General Disqualification

Any attempt made by an entrant or other individual or entity, to deliberately damage, manipulate or undermine the legitimate operation of the Contest, including but not limited to any fraudulent claims, is a violation of the law. The Administrator and Sponsor reserve the right to seek remedies and damages from any such individual or entity which makes any such attempt. Any entrant who, in the opinion of the Administrator, is determined to be engaging in any of the foregoing activities will be immediately disqualified from the Contest.

17. The Contest Rules Prevail

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these English Rules shall prevail, govern, and control to the fullest extent permitted by law.

18. Role of Parties

Sobeys Capital Incorporated is the Sponsor and XMC Experiential Marketing is the Administrator of this Contest.

The Contest is in no way sponsored, endorsed or administered by, or associated with Apple Inc.® or Google LLC. You understand that you are providing your information to the Sponsor and Administrators of the Contest and not to Apple Inc.® or Google LLC. Apple Inc.® and Google LLC are completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding this Contest must be directed to the Administrators of the Contest and not to Apple Inc.® or Google LLC.

19. Trademarks

All other trademarks are the property of their respective owners.

20. Jurisdiction

The Contest is governed by the laws of Ontario and the laws of Canada applicable therein, and is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited by law. Participation constitutes your full and unconditional agreement to these Contest Rules and the decisions of the Sponsor and Administrator, which are final and binding in all matters related to the Contest. By entering the Contest, you agree that the courts of Ontario, Canada shall have jurisdiction to entertain any action or other legal proceedings based on any provision of this Contest’s Rules or the running of this Contest.
